Terms & conditions
1. THE SUBJECT OF THE TERMS AND CONDITIONS
The present Regulations govern:
1.1 the action of the "Gomez.pl" online store,
1.2. the setting-up of a Gomez Account at the "Gomez.pl" online store,
1.3. the sale of goods in the "Gomez.pl" online store,
1.4. the payment for placed orders,
1.5. the procession of an order,
1.6. the complaints procedure,
1.7. withdrawal from the contract
and other general contractual conditions of the sale of goods within the framework of the Gomez.pl" online store.

2.2 The online store „Gomez.pl” - an online store run within the framework of the conducted business activity, operating at www.gomez.pl.
2.3 Terms and conditions – the present regulations of the „Gomez.pl” online store are available on the website „www.gomez.pl” under the section „Terms and Conditions”.
2.4 A Customer – any person placing an order at the „Gomez.pl” online store,
2.5 Customer Account - registered individual's account on the website of the online shop "Gomez.pl", precipitating the process of placing an order and enabling for the Customer of "Gomez.pl" to use additional functions of the online store, established in the way determined in point 6 of the Regulations,
2.6 A Party - Customer or Gomez (called Parties altogether)
3. THE RULES OF OPERATION OF THE "GOMEZ.PL" ONLINE STORE
3.1. Gomez offers organised sale of goods via the Internet, available at the "Gomez.pl" online store.
3.2. On sale in the "Gomez.pl" online store there are, in particular, clothes, footwear and women's, male and children's accessories.
3.3. Goods sold via the online store are described in detail. At the site of each product a picture, and information about the price is given along with its properties - in particular material, from which the product is made, the size, brand, care instructions, producer or importer's name and his address etc.
4. THE SALE OF GOODS
4.1 The sale of goods available in the “Gomez.pl” online store is made by placing an order by a remote Customer through the website www.gomez.pl. Placing the order is understood as clicking by the customer "I order with payment obligation"button at online store „Gomez.pl”
4.2 By placing an order a Customer chooses a product/products, its size and color (if a choice is possible), and also a number of products ordered, and then chooses a method of payment & delivery.
5.1 Prices given in the online store are indicated in Polish złoty (PLN) at gross price (including all due taxes and customs).
5.2 The appropriate costs of delivery indicated in point 9, depending on the delivery method chosen, shall be added to the price of the product.
6. CUSTOMER ACCOUNT
6.1 Within the framework of the “Gomez.pl” online store every Customer can start an individual Customer Account (optionally)
6.2 Creating and using Customer Account is free of charge
6.3 Creating Customer Account speeds up the process of placing the order by the Customer (data used for processing the order are automatically taken from data submitted by the Customer when registering) and allows the Customer to use the additional functions in online store „Gomez.pl”, such as:
6.3.1. "Your discount" - allowing the customer to check: ongoing granted discount, conditions which should be met to be granted higher discount level or other potential benefits ascribed to the Customer,
6.3.2. "Followed" - allowing the Customer to follwo products which were added to "Followed" with the use of "Follow" button on the product's site "Order history" - allowing the Customer viewing the history of his/her orders and their status,
6.3.3. "My personala data" - allowing the Customer the access to submitted personal data, expressed consents, their changes or deletion.
6.3.4. „Order history"- allowing the Customer the access to placed orders and check their status
6.3.5. „Go to cart" - allowing the Customer to go to the cart including the products added to the cart in the current session, not yet included in placed order.
6.4. In order to create a Customer Account go to the website of the “Gomez.pl” online store: www.gomez.pl
6.5 In order to create a Customer Account you need to:
6.5.1 click on the “Register” button on the website of the online store „Gomez.pl”
6.5.2 fill in a registration form:
18.104.22.168. obligatory submit the following data: full name, contact address (city, zip code, street, flat number, country), e-mail address, phone number, or, in the case of individual entity, PESEL
22.214.171.124. in case of Customer running his own business, it is obligatory to submit company name and tax ID
126.96.36.199. optionally preferred language for communication or the source from which you learned about „Gomez.pl” can be submitted
188.8.131.52. enter individually chosen password allowing the access to Customer Account, meeting the requirements stated in section 6.6,
184.108.40.206. confirm that the Customer knows and accept Terms & conditions,
220.127.116.11. if you wish to enter Gomez Club (discount program), click "Gomez Club program - discount system" (to check currently granted discount, conditions which should be met to be granted higher discount level is under "Your discount" tab on Customer Account)
18.104.22.168. agree to the processing of personal data to set and run Customer Account of „Gomez.pl”, optionally agree to other purposes of data processing pointed there
22.214.171.124. after having filled all the necessary details click on the “Send” button at the end of the form, after having filled all the necessary details click on the “Send” button at the end of the form to set Customer Account (if the form is not filled out correctly, there will be notification appeared on the site. In that case the from should be filled out properly again; then click on the “Send” button
6.5.3. information on having set the Customer Account will appear, the information including the data submitted during registration (except for the password) and submitted declarations and consents will be automatically e-mailed to e-mail address submitted by the customer during registration
6.6. Password allowing access to the Customer Account should consist of at least 8 signs, including upper and lower case, digits and special sings and should be changed by the customer at least every 30 days.
6.7. To access Customer Account at „Gomez.pl” enter e-mail address and individual password to Customer Account submitted during registration into login form at the top of the page of online store „Gomez.pl” and click "Arrows" icon on the right side of login form ("Log in"button)
6.8. Details on Customer Account are available after clicking "My account" button at the right top corner of the page.
6.9. To alter Customer Account (personal data or submitted statements and consents):
6.9.1. log in to Customer Account
6.9.2. click on the “My Account” button at the top right corner of the page
6.9.3. choose the section “Personal information”
6.9.4. after having filled all the alterations click on the “Change” button next to the proper data/statements/consents
6.9.5. in the case where cancelling the consent makes it impossible to process the agreement with the Customer (i.e. not accepting the Terms & conditions, not consenting to processing the data needed to set and run Customer Account of online store „Gomez.pl”. Those consents cannot be altered - Customer Account must be deleted instead, the same regards deleting data submitted obligatorily (obligatory) during registration - go to section 6.5.2.
6.10. In order to delete a Customer Account go to "Delete Customer Account in "Account options" in Customer Account zone or contact the Customer Service either via e-mail or by writing (contact data in section 15 of this Terms & conditions
7. Detailed instruction on placing the order
The placement of an order by a client is as follows:
7.1. First clicks on the icon of a product available on the “Gomez.pl” online store to access the item’s webpage.
7.2. On the item’s webpage click on the icon “ Add to cart”. Thus, the item is added to the cart.
7.3. The notification about adding the product to the cart wiil appear. If you wish to continue shopping, click "Cancel" in response to the question in notification and add the next item to the cart in the way pointed in section 7.2 of another page of the product. If you wish to place the order, click "OK" in response to the question in notification or "Show the cart" button at the top right corner of “Gomez.pl” online store
7.4. When on the webpage of the cart, to place an order you need to click on the icon “Next”.
7.5. The customer will be automatically redirected to the page for placing the order, which consists of four steps:
7.5.1. In step 1 - "Accepting the order" you will see the information about ordered products, their prices, granted discount and total price; if the Customer has discount code and wish to use it, he/she should enter it in "Discount code" filed and clisk "Check the code" button. To delete entered discount code. click "Reset the code". You should check order details (if they need to be changed, mark the product that should be deleted in "Delete" column, then click "Delete marked items"; to change the quanity of ordered products, enter the proper amount in "Quantity" column, then click "Calculate" to save changes, then click "Next" to enter the page choosing the way to continue placing the order.
7.5.2 On the page choosing the way to continue placing the order you should choose the way to continue placing the order. You can continue to place the order without registering Customer Account (click "Continue without registration") or log in to Customer Account (enter access data and click "OK"). If Customer Account wasn't previously set, it can be set by clicking "Register" and going through registration steps, after setting Customer Account go back to Cart page and start placing the order again according to section 7.4.
7.5.3.Then you are automatically redirected to the page of "STEP 2 - Payment and delivery"
7.5.4. In "STEP 2 - Payment and delivery" different methods of payment and delivery and their cost will appear. The Customer can choose from different methods of payment and delivery, allowing to pay in advance or on delivery ( available delivery options for each payment method and their cost were pointed in 8 and 9 point of Terms & conditions). One method of payment and delivery should be chosen together with data needed to process the order:
a) The following data should be entered obligatory: Full name, contact address (city, zip code, street, flat number, country), e-mail address, phone number, PESEL in the case of individual entity
b) In the case of Customer running his/her own business, company name and tax ID should be submitted
c) information about preferred language for communication or the source from which you learned about „Gomez.pl”.
In the case of logging in to Customer Account you can use automatically entered data submitted during registration of Customer Account ("Like in my data" option) or choose "Use other data" option and enter data needed to process the order. Then you should confirm viewing and accepting Terms & conditonos by marking the proper field ("YES, I know and accept Terms & conditions and as a customer I'm granted 14-day right to withdraw from the agreement"). In the field "Notes to the order" you can enter the additional notes to your order. To go to the next steo of placing the order click "Next".
7.5.5. You will be automatically redirected to the "Step 3 - Summary"
7.5.6. In "Step 3 - Summary" the summary of placed order will appear, including especially data for processing the order, information about Gomez data, ordered products, their prices, chosen delivery option and its cost, chosen payment method and its cost and total price, payment and delivery term, submitted statements and consents and an obligation to deliver the flawless product, the right to withdraw from the contract, procedure of making complaint, extrajudicial ways of processing complaints and compensation claims and other required information, you should check order details, entered personal data and content of submitted statements and consents (in case of them being incorrect, they should be corrected by clicking "Go back") and click "Order with payment obligation" button which results in placing the order that entails the obligation to pay the sum indicated in the summary (tantamount to valid agreement under conditions stated in order summary and this Terms & conditions).
7.5.7. You will be automatically redirected to the "Step 4 -"Accepted for processing".
7.5.8. The information about accepting placed order for processing by Gomez; the summary of placed order showed in "Step 3 - Summary"will be automatically emailed to the address submitted by the Customer. In the case of choosing "Prepayment" as a payment method data needed for making transfer will be showed. In the case of choosing "Card/Przelewy24” you will be automatically redirected to online page for making payments. You should follow the instruction of corresponding opertor of online payments. After finishing payment procedure you will be automatically redirected to the page confirming placed order including the information of successfully completing payment procedure.
7.6. If the Customer has Customer Account the placed orders are visible also in Customers Accounts zone in "Order history" tab.
7.7. In the case of non-delivery due to stock shortage, Gomez shall immediately inform the Customer, who can withdraw from the agreement without indicating additional term. In the case of claiming the right of withdrawal, Gomez shall immediately return all payments made by the Customer
8. SPOSOBY PŁATNOŚCI
8.1.The following methods of payment are available:
a)by a bank transfer (“Bank transfer”)
b) by a credit card (“Card/Przelewy24”)
c) by a money transfer service Przelewy24 (“Przelewy24”)
8.1.2. At the time of collecting the goods:
a) via option collect on delivery („On delivery”)
b) at the stationary store (“Personal collection”)
8.2. The payment method is chosen on the webpage “ Step 2 – Payment and delivery”, which is referred to in the section 7.5.3.
8.3. If the method “Bank transfer” is chosen the details for transaction will be showed directly after placing the order or are available in the tab of the order in Customers Accounts zone in "Order history" section. If the Customer doesn't have Customer Account, transfer details will be showed only directly after placing the order
8.4. If the method “Card/Przelewy24” is chosen, the money transfer disposition can be made right after the placement of the order or later, in a given order in Customers Accounts zone in "Order history" section. If the Customer doesn't have Customer Account, the payment can be made this way only directly after placing the order. After pressing the button starting the payment procedure, you should follow the instruction of corresponding opertor of online payments. After successfully completing payment procedure you will be automatically redirected to webpage with the information about successfully completing payment procedure.
8.5. Term of payment in advance is 5 days of placing the order.
8.6. In case of choosing "On delivery" payment method, the payment is handed to the courier on collecting the parcel.
8.7. In case of choosing “Personal collection” at the stationary store the payment is handed to the assistant at Gomez stationary store on Drobika 4-14 in Poznań or/and Diamentowa 9 in Suchy Las when the goods are collected.
9. Delivery/Collecting the order
9.1. Available are the following methods of delivery or the collecting of goods:
9.1.1. shipping via courier to the address indicated by the Customer,
9.1.2. delivery to InPost locker indicated by the Customer,
9.1.3. personal collection (or by an authorized person) in the stationary Gomez store on Drobika 4-14 in Poznań or/and Diamentowa 9 in Suchy Las
9.2. The costs of delivery within the region of Poland are as follows:
9.2.1. when choosing pre-payment and the delivery via courier – 14 PLN
9.2.2. when choosing pre-payment and the delivery via InPost Locket - 16 PLN
9.2.3. when choosing “On delivery” and the delivery via courier - 16 PLN
9.2.4. when choosing “On delivery” and personally collecting goods – 0 PLN
9.2.5. If the total worth of products purchased exceeds 200 PLN, the delivery via DHL in the region of Poland is free of charge.
9.3. The delivery outside the borders of Poland is available to: Andora, Austria, Belgium, Croatia, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Ireland, Italy, Latvia, Lichtenstein, Lithuania, Luxemburg, Monaco, Holand, Norway, Portugal, Slovakia, Slovenia, Spain, Sweden, Switzerland, Turkey, Great Britain.
9.4. The costs of shipping the goods outside the borders of Poland are given in accordance to the price-list of GLS/Polish Post. To settle the exact charge for the delivery you shall contact Gomez. The cost of shipping outside the borders of Poland depend on destination country and weight of the parcel. The information about the cost of shipping is e-mailed by Customer Service.
9.5. In accordance with transport law, if prior to the receiving of goods it transpires that the parcel suffered a defect or damage, Customer shall demand an immediate protocol statement, establishing the state of the parcel and the circumstance of the occurrence of the damage from the courier. If the defect or damage which could not be detected from the outside is revealed after the receiving of goods, Customer shall immediately but no longer than after 7 days from the date of delivery of the goods to report to the courier a demand for establishing the state of the parcel.
10. ORDER PROCESSING TIME
10.1.The total duration of processing of an order amounts to the maximum of 30 days from the day of placing an order by a Customer, nonetheless Gomez makes every effort to keep the order processing time at minimum. In the case of delay, the Customer may point out additional term for issuing the product, and withdraw from the agreement after non-delivery withing that term
10.2. Typically the order processing time is shorter than 30 days and is as follows:
10.2.1. in the case of prepayment orders are processed and sent (or ready for personal collection) within 1 day after receiving Customer's payment
10.2.2. in the case of “On delivery” orders are processed and sent (or ready for personal collection) within 1 day after the placement of an order
10.2.3. estimated time of delivery to InPost Locker is 1-2 days of post date
10.2.4. estimated time of delivery of non-priority orders via GLS is 48 hours of post date
10.2.5. estimated time of delivery of orders outside the borders of Poland via GLS is 5 days
11. THE RIGHT OF WITHDRAWAL
11.1. A Customer who is a consumer shall be entitled to withdraw from the Agreement with Gomez within the framework of the “Gomez.pl” online store without giving any reason
11.2. The term of withdrawal from the agreement expires after 14 days from the date of collecting the product by the Customer or when the third party other than the carrier and appointed by the Customer collected the product.
11.3. To exercise the right of withdrawal, the Customer shall inform Gomez about his/her decision through explicit statement (i.e. form e-mailed, posted or handed over to the stationary store). Contact data and Gomez stationary store addresses are listed in section 15 of Terms & conditions.
11.4. The Customer may use ready-made withdrawal form, however it's not obligatory.
11.5. Withdrawal form is the attachment to Terms & conditions. Withdrawal form is also the attachment no.2 to Consumers' rights act from the 30th of May 2014 (Journal of Laws, 2014, sec.827).
11.6. To abide by the term of withdrawal, the Customer shall simply send the information about exercising the right he/she's entitled to within the term of withdrawal.
11.7. In the case of withdrawal from the agreement, all the payments made by the Customer including shipping cost are returned (with the exception of extra costs rising from delivery method other than the cheapest possible way offered by Gomez) immediately, in any case within 14 days from the day when Gomez was notified of Customer's decision of withdrawal from the agreement. Gomez may put the return on hold till the moment of receiving the product or a proof of sending it back, depending on which occurs first.
11.8. Payment will be returned with the same payment method as used in original transaction, unless the Customer agrees to other solution. In any case the Customer will incur no cost regarding the refund.
11.9. The customer is obliged to send back the product or deliver it to stationary store without delay, in any case within 14 days from the day when Gomez was notified of Customer's decision of withdrawal from the agreement. The term is respected if the Customer sends back the product before 14 day period passes. Contact data and Gomez stationary store addresses are listed in section 15 of Terms & conditions.
11.10. The Customer incurs direct cost of return.
11.11. The Customer is liable for lessening the value of the product due to using it for purposes other than to assess its traits, qualities and functionality.
11.12. The right of withdrawal from the remote agreement is not applicable regarding agreements:
11.12.1. for services, if Gomez provided completed service with Customer's clear consent, where the Customer had been notified before the service began, that after the completion of service by Gomez, he/she would lose the right of withdrawal,
11.12.2. where price and salary depends on fluctuation on financial market, which is out of Gomez' control and which can occur before the term of withdrawal.
11.12.3. where object is not prefabricated, produced according to Customer's specification or serving his/her individual needs
11.12.4. where object is easily worn out and has short expiry date,
11.12.5. where object is delivered in sealed package, which cannot be returned after opening for the sake of health protection or hygiene concerns, if the pack ws opened after collecting it.
11.13. Withdrawal form can be sent to the address pointed in section 15 of Terms & conditions.
12.1. Gomez is obliged to deliver flawless product to the Customer
12.2. Gomez is liable to a Customer who is a consumer if a product has legal or physical flaws
12.3.Physical flaw amounts to non-compliance with the agreement, especially when the product:
12.3.1. doesn't have the properties which the item of that sort should have due to the purpose indicated in the agreement or resulting from circumstances or its purpose,
12.3.2.doesn't have the properties of which the Customer was assured by the seller, including the sample or template,
12.3.3. is not suitable for the purpose stated by the Customer on making the agreement with the seller, where the seller didn't deny that sort of purpose,
12.3.4. was delivered to the Customer incompleted.
12.4. Public assurance of the producer or his representative, entity introducing the product on the market within the business he runs and an individual who claims to be a producer by putting his name, trademark or other signature is equal to assurances made by the seller. Nontheless Gomez is not liable to a Customer for the lack of properties stated in public assurances (of producer or his representative, entity introducing the product on the market within the business he runs and an individual who claims to be a producer by putting his name, trademark or other signature) if he wasn't familiar with those assurances or after reasonable assessment, couldn't have known, also in the case where it couldn't have influenced his decision about making sales agreement or when the assurance wa rectified before the agreement was made.
12.5.Gomez is liable to the Customer if the sold product belong to a third party, is charged with the right of third party, or when the limitation on using or managing the product results from the decision or claim of respective entity; in the case of selling the right the seller is also responsible for the existence of the right (legal flaw).
12.6. Gomez is released from warranty claims, if the Customer knwe about the fault in the moment of making agreement.
12.7. On account of warranty claims Gomez is responsible for physical flaws which existed in the moment of shifting the risk on to the Customer or resulted from the reason within sold product at this very moment.
12.8. If the product is faulty, the Customer can:
12.8.1. claim the exchange for flawless product or removal of the flaw; in that case Gomez is obliged to exchange the faulty product for flawless one or remove the flaw in reasonable period of time withour excessively inconveniencing the Customer. Gomez may deny the reimbursement the Customer, if making the faulty product comply with the agreement in a way chosen by the Customer is not possible or in comparison with the other possible way of making the faulty product comply with the agreement would be too expensive,
12.8.2. make a statement on lowering the price or withdrawal from the agreement, unless Gomez exchanges pthe product for flawless one or remove the flaw without delay or excessive inconvenience for the Customer; the right of the seller is compromised in a way stated in sections 126.96.36.199 and 188.8.131.52; lowered price should stay in the same proportion to the price stated in the agreement, as the value of faulty product to the value of flawless one,
184.108.40.206. under conditions stated in section 12.8.2, Gomez cannot exchange the product for flawless one or remove the flaw if the product has already been exchanged or fixed by Gomez or Gomez didn't fulfil its obligation to exchange the product for flawless one or remove the flaw,
220.127.116.11. under conditions stated in section 12.8.2, the Customer may claim the exchange for flawless one instead of removing the flaw by Gomez or removing the flaw instead of exchanging, unless making the faulty product comply with the agreement in a way chosen by the Customer is not possible or in comparison with the other possible way of making the faulty product comply with the agreement would be too expensive; assessing the excessiveness of the cost the value of flawless product, kind and significance of stated flaw and inconvenience the Customer would have been subjected to using another form of reimbursement are taken into account.
12.9. The Customer cannot withdraw from the agreement if the flaw is irrelevant.
12.10. The Customer claiming warranty or exchanging for the flawless product is obliged to deliver faulty product to Gomez at the seller's expense. Contact information are pointed in section 15 of Terms & conditions.
12.11. Gomez incurs the cost of exchange or fixing the product.
12.12. The seller is obliged to accept faulty product from the Customer in the case of exchanging it for flawless product or withdrawal from the agreement.
12.13. If the Customer who is a consumer claimed the exchange of the product or removing of the flaw, or submitted the form on lowering the price declaring the sum by which the price is supposed to be lowered, and the seller did not take a stand on this claim within 14 days, it is considered justified.
12.14. If the sales agreement states that the delivery of sold goods is to be split in parts, and Gomez didn't deliver the same quantity of flawless products instead of faulty ones despite Customer's request, the Customer has the right to withdraw from the agreement, also regarding the part of the delivery which is to be delivered later on.
12.15. If amongst sold products only a part of them, (which can pe separated) is faulty without compromising any of the parties, the right of withdrawal is restricted only to the faulty products.
12.16. Gomez is liable to respect warranty claims, if the physical flaw is confirmed before two year period from the day of collecting the product to the Customer. Issuing the product to the carrier where Gomez had no influence on Customer's choice of the carrier is considered the goods issue.
12.17. Claims concerning removal of the flaws or exchanging for flawless products expire after a year from the day of confirming the flaw. The term of expiry runs till the end of the term pointed in section 12.16.
12.18.The Customer may submit withdrawal form or file for lowering the price due to the non-compliance in the term pointed in section 12.16. If the Customer claimed the exchange ofr the flawless product or removal of the flaw, the term for submitting the withdrawal form or filing for lowering the price runs from the expiry date of ineffective term of exchange or removal of the flaw.
12.19. In the case of appealing to the court or conciliatory court regarding one of warranty claims, the term of executing other rights which the Customer is entitled to is suspended till the date of legally binding conclusion. The regulation is applicable to mediation process, nonetheless the term to execute the other warranty claims which the Customer is entitled to, runs from the date of rejection of the settlement with the mediator by the court or ineffective facilitating process.
12.20. If the expiry date stated by Gomez or the producer terminates after two years time from the date of issuing of the product to the Customer, Gomez is liable for physical defects confirmed within that period on account of warranty claims.
12.21. Rights rising from warranty concerning legal defects are executed according to section 12.15 - 12.19 of Terms & conditions, however the term runs from the day when the Customer found out about the flaw, if the Customer lerned about the flaw because of the complaint of the third party - from the day when the statement made in the argument with the third party became legally binding.
12.22. Complaints can be directed to the address pointed in section 15 of Terms & conditions.
12.23. Exemplary complaint form is attached to these Terms & conditions.
13.1.Customer's personal data will be processed in accordance with the Act of 29 August 1997 on the Protection of Personal Data (The Journal of Laws of 2014, No. 101, item 1182)
13.2. If the Customer places the order, Gomez processes personal data pointed in section 6.5.2 and 7.5.4 of Terms & conditions to realize the order. Submission of Customer's personal data in order to set up and use the Customer Account is voluntary, however, not submitting (or removal of) personal data which is obligatory due to the character of the service, in order to set up and use the Customer Account (obligatory data were pointed in section 6.5.2 and 7.5.4) results in failure to establish and, in turn, use of the Customer Account.
13.3. If the Customer establish Customer Account, Gomez processes personal data pointed in section 6.5.2 of Terms & conditionsin order to establish and use Customer Account of „Gomez” online store. Submission of Customer's personal data in order to set up and use the Customer Account is voluntary, however, not submitting (or removal of) personal data or not granting consent to the processing of personal data in order to set up and use the Customer Account results in failure to establish and, in turn, use of the Customer Account.
13.4. If the Customer grants consent, Gomez processes personal data pointed in section 6.5.2 and 7.5.4 of Terms & conditions for marketing purposes. Submission of Customer's personal data for marketing purposes is voluntary.
13.5. If the Customer grants consent, Gomez processes personal data pointed in section 6.5.2 and 7.5.4 of Terms & conditions to provide sales information via electronic service. Submission of Customer's personal data to provide sales information via electronic service is voluntary.
13.6. The personal data administrator is Gomez Sp. z o.o. Sp. K. ul. Tomasza Drobnika 2, 60-693 Poznań, REGON 364534202, tax ID 9721264099.
13.7. To facilitate the use of www.Gomez service, it utilizes so-called cookies technology - information entered into Gomez server in user's computer. It is not used to obtain any data from server users. The user can at any time turn off the option of accepting cookies in his/her browser. However it may result in some impediments when using www.Gomez service.
13.8. www.Gomez service uses the following cookies:
13.8.1. PHPSESSID - session cookie, existing only during browser session. It is essential for proper working of www.Gomez service
13.8.3. _utma -cookie saved in computer's disc during the first visit on the site, the cookie has a unique ID number by which analitical device can determin whether the user is unique or new,
13.8.4. _utmb – cookie _utmb saves information about any given visit,
13.8.5. _utmc in connection with _utmb establish whether to start following the new visits or include the data into existing visits.
13.8.6. _utmz – cookie storing information about the source of the visit. It enables i.e. to count browser visits. The file is updated after viewing each site, its service life lasts 6 months.
13.9. Changes in cookies storage and receiving can be made through configuration of browser settings i.e.:
13.9.1. Internet Explorer
13.9.2. Mozilla Firefox
13.11. Collected logs of the server (IP address, domain) are stored for an indefinite period of time and used for generating statistics facilitating the administration of www. Gomez service. Detailed information stored in logs' files of WWW server is as follows:
13.11.1. public IP address of the computer from which the request was sent (it can be directly user's computer),
13.11.2. name of Customer's station - identification realized by http protocol if it is possible,
13.11.3. user name submitted in authorization process,
13.11.4. time of submitting te inquiry,
13.11.5. the first line of http request,
13.11.6. http response code,
13.11.7.number of bytes sent through the server,
13.11.8. URL address of the site previously visited by the user (referer link) - in the case where redirecting to www.Gomez occured via link,
13.11.9. information about user's browser,
13.11.10. information about http errors occurred during transaction
13.12. Summaries are collective and don't include qualities identifying www.Gomez visitors. Logs are not disclosed to the entities not involved in www.Gomez administration. Statistics helpful in administration can be generated with the use of log files.
13.13. Technical requirements needed to cooperate with ICT system used by Gomez are as follows:
13.13.1. minimal requirements:
Internet browser of suitable application;
existing submitted e-mail address which allows to transmit data related to processing the order.
13.14. „Gomez” online store does not provide electronic service to anonymous entities or those using nickname due to the character of the service (that is processing the order placed by the Customer via "Gomez" online store - obligatory data were pointed in section 6.5.2 and 7.5.4.
13.15. In accordance with the Regulation of the Minister of Interior and Administration on the Protection of Personal Data (The Journal of Laws of 2014, No. 101, item 1182) Gomez provides a high level of technical means of security regarding personal data transmitted electronically by „Gomez” online store to prevent them being obtained and modified by unauthorized entities, Gomez uses especially:
13.15.1. means of cryptographic protection on the data used for authentication, transmitted in public network and on the content submitted by the Customer through „Gomez” online store,
13.15.2.use of electronic service by the Customer in a way blocking the access of unauthorized entities
13.15.3. physical or logical safety means blocking unauthorized access, especially:
control over information flow between IT system of data administrator and public network,
control over the actions initiated by public network and IT system of data administrator
13.15.4. Protection from the software aimed at gaining unauthorized access to IT system, allowing the access to the data only after entering ID and au·then·ti·cat·ing with password that is strong enough (separate ID for each user).
13.16.There are the following notable dangers in reference to using electronic service:
13.16.1. computer piracy,
13.16.2. receiving unsolicited electronic sales notification (spam),
13.16.3. malware, especially virus, bug, trojan horse, spyware, wabbit, keylogger, rootkit,
13.16.4. cracking software firewall
13.16.5. eavesdropping programs (sniffing),
13.16.6. decoding data (cryptanalysis)
13.16.7. hackers' actions
13.17. To avoid the above dangers the Customer should equip his/her device connected to the network with updated antivirus software and firewall. Moreover the Customer should equip his/her e-mail with software detecting viruses in mails and check imported data before opening them with the use of file scanning module of antivirus software.
13.18. Submitting unlawful content within the framework of "Gomez" online store is forbidden.
13.19. The Customer has the right to make complaint regarding "Gomez" online store operational actions within the term of 14 days from the day of the occurrence against which the complaint is made. The complaint can be directed to Gomez in writing or by e-mail to the addresses pointed in section 15 of Terms & conditions.

14.1. Rights for the content of the "Gomez" online store , including page layout, images, trademarks, logos and other content and elements, are entitled to "Gomez".
14.2. Therefore, it is prohibited to copy, modify, or in other way use the "Gomez.pl" online store or any of its components without Gomez's permission.

16. FINAL PROVISIONS
16.1. If the Customer is a consumer, in the matters not covered by these Term and Conditions or the Agreement, applicable is the law of habitual residence of the Customer. If these measures provide for a higher level of consumer protection than indicated in these Term and Conditions, the Parties shall apply to the provisions of these regulations.
16.2. If the Customer is not a consumer, in the matters not covered by these Term and Conditions or the Agreement, applicable are the provisions of Polish law and the competent courts for the settlement of disputes between the Parties are the Polish courts.
